General Information

The protection of your privacy and the legally compliant processing of your personal data are important to us. As the data controller, we would like to make the processing transparent for you and inform you in the following data protection declaration about how your personal data is processed when you contact us and enter into a contractual relationship with us.

Personal Data

We, RK3 Verwaltungs GmbH (contact details see below), collect, process and use your personal data only with your consent for the purposes agreed with you or if there is another legal basis in accordance with the GDPR; this in compliance with data protection and civil law provisions.

Only such personal data is collected that is necessary for the implementation and processing of our business relationship and for the fulfillment of (pre)contractual obligations or that you have voluntarily provided to us.

Personal data is all data that contains individual details about personal or factual circumstances, for example name, address, email address, job title, telephone number, date of birth, age, gender, social security number.

Information and Deletion

As our customer or generally as a data subject, you have the right at any time to information about your stored personal data, its origin and recipients and the purpose of the data processing, as well as a right to correction, data transfer, objection, restriction of processing and blocking or deletion of incorrect or inadmissible processed data.

If there are any changes to your personal data, we ask that you notify us accordingly.

You have the right to revoke your consent to the use of your personal data at any time. Upon receipt of the revocation declaration, your data will be deleted, provided that there are no statutory retention periods to the contrary and the revocation is effective (see point 7). Your request for information, deletion, correction, objection and/or data transfer, in the latter case, provided that this does not cause disproportionate effort, can be sent to the address of RK3 Verwaltung GmbH stated in point 10 of this declaration.

If you are of the opinion that the processing of your personal data by us violates applicable data protection law or your data protection rights have been violated in any other way, you have the option of complaining to the responsible supervisory authority. In Austria, the data protection authority is responsible for this.

Data Security

The protection of your personal data is ensured by appropriate organizational and technical precautions. These precautions concern in particular the protection against unauthorized, unlawful or accidental access, processing, loss, use and manipulation.

Regardless of the efforts to maintain a consistently high standard of due diligence requirements, it cannot be ruled out that information that you provide to us via the Internet may be viewed and used by other people.

Please note that we therefore assume no liability whatsoever for the disclosure of information due to errors in data transmission and/or unauthorized access by third parties not caused by us (e.g. hacking attack on email account or telephone, interception of faxes).

Use of Data

We will not process the data provided to us for purposes other than those of the business relationship and for the fulfillment of (pre)contractual obligations through your consent or otherwise through a provision in accordance with the GDPR. Excluded from this is the use for statistical purposes, provided that the data provided has been anonymized.

Transmission of Data to Third Parties

To fulfill our (pre)contractual obligations, it may also be necessary to pass on your data to third parties (e.g. magistrate, etc., which we use and to whom we provide data, etc.). Your data will only be forwarded on the basis of the GDPR, in particular to fulfill the business relationship or on the basis of your prior consent. Your data will of course only be passed on to the extent that it is necessary for the respective purpose of processing.

Some of the above-mentioned recipients of your personal data are located outside your country or process your personal data there. The level of data protection in other countries may not correspond to that of Austria. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients have an adequate level of data protection.

Disclosure of Data Breaches

We endeavor to ensure that data breaches are identified early and, if necessary, reported to you or the responsible supervisory authority without delay, including the respective data categories that are affected.

Retention of Data

We will not store data longer than is necessary to fulfill our (pre)contractual or legal obligations and to defend against any liability claims.

Consent to the use of cookies.

In order for our website to function properly, we use cookies. In order to obtain your valid consent to the use and storage of cookies in the browser you use to access our website and to properly document this, we use a consent management platform: CookieFirst. This technology is provided by Digital Data Solutions BV, Plantage Middenlaan 42a, 1018 DH, Amsterdam, The Netherlands. Website: https://cookiefirst.com referred to as CookieFirst.

When you access our website, a connection is established with the CookieFirst server to enable us to obtain valid consent from you for the use of certain cookies. Agreement on data processing

We have concluded a data processing agreement with CookieFirst. This is a data protection contract that ensures that the data of our website visitors is only processed in accordance with our instructions and in compliance with the GDPR.

Server log files

Our website and CookieFirst automatically collect and store information in so-called server log files, which your browser automatically transmits to us. The following data is collected:
